1. Acceptance of Terms

By accessing or using PlanMaxx (planmaxx.app), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our service.

2. Service Description

PlanMaxx provides AI-powered analysis of NDIS plans, generates plan review submission documents, practitioner letter templates, evidence checklists, and budget tracking tools. Our service is designed to assist NDIS participants, their families, support coordinators, and advocates in preparing plan review requests.

3. Important Disclaimers

  • Not legal advice: PlanMaxx is an informational and document preparation tool. The submissions, letters, and analysis we generate do not constitute legal advice. We are not a law firm, and using our service does not create a lawyer-client relationship.
  • Not affiliated with the NDIA: PlanMaxx is an independent service and is not affiliated with, endorsed by, or connected to the National Disability Insurance Agency (NDIA) or the Australian Government.
  • No guarantee of outcomes: While our analysis is based on comparison with hundreds of thousands of NDIS plans and relevant legislation, we cannot guarantee that your plan review will be successful or result in increased funding. Outcomes depend on many factors including the NDIA's assessment of your individual circumstances.
  • AI-generated content: Documents generated by PlanMaxx are created using artificial intelligence. While we strive for accuracy, you should review all generated content before submission and seek professional advice if you have concerns about your specific situation.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Ensuring that the NDIS plan documents you upload are your own (or you have authorisation from the participant/nominee to upload them).
  • Reviewing all generated documents before submitting them to the NDIA or any other party.

5. Payments and Refunds

  • Pricing: The Plan Review Submission Package is a one-time payment of $297 AUD. Free plan analysis is provided at no cost.
  • 30-Day Money-Back Guarantee: If you are not satisfied with your submission package for any reason, you may request a full refund within 30 days of purchase. Contact refunds@planmaxx.app to initiate a refund.
  • Payment processing: All payments are processed securely by Stripe. We do not store your credit card details.
  • No recurring charges: Your purchase is a one-time payment. We will never charge you again without your explicit consent.

6. Intellectual Property

Documents generated by PlanMaxx for your plan review are yours to use as you see fit. You own the content of your submissions, letters, and reports. However, the PlanMaxx platform, algorithms, branding, and underlying technology remain our intellectual property.

7. Acceptable Use

You must not:

  • Upload documents that do not belong to you without proper authorisation.
  • Use the service to generate fraudulent or misleading NDIA submissions.
  • Attempt to reverse-engineer, copy, or redistribute our analysis algorithms or platform.
  • Use automated tools to scrape or bulk-access the service.
  • Share your account credentials with others.

8. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, PlanMaxx's liability is limited to the amount you paid for the service. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to unsuccessful plan reviews or changes to NDIS funding.

9. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or by posting a notice on our website. Continued use of the service after changes constitutes acceptance.
